The U.S. Department of the Treasury is holding Tribal Consultation on Tribal employers’ participation in the CARES Act Paycheck Protection Program (PPP) today from 1:30 p.m. ET to 2:30 p.m. ET.

Tribes nationwide have protested the U.S. Small Business Administration’s (SBA) oversight of Tribal Government Gaming in the emergency relief available through the Paycheck Protection Program (PPP), part of the $2.2. trillion Coronavirus Aid, Relief and Economic Security (CARES) Act. Loans preclude businesses that derive more than one-third of their gross annual revenue from legal gambling activities.

The PPP loans enable certain businesses with 500 or fewer employees to obtain loans of up to $10 million. Part or all of the loan may be forgivable, dependent on the loan’s use. The loans can be applied to payroll, group health benefit insurance premiums, rent payment, interest payments on loans, and utilities during the “covered period” between February 15, 2020, and June 30, 2020.

At the request of Tribes, the U.S. Department of the Treasury is holding Tribal Consultation on Tribal employers’ participation in the CARES Act PPP today from 1:30 p.m. ET to 2:30 p.m. ET. The consultation will be held jointly with the SBA.

The consultations will engage Tribal leaders wishing to comment on two provisions of the CARES Act:  1) the Paycheck Protection Program, and 2) the Employee Retention Credit.

These meetings are Tribal Consultations with primary Tribal leaders or their designee; the consultations are off the record and not for press purposes.

The Treasury emphasized that “primary Tribal leaders are invited to address their concerns to Treasury.” A statement from the Treasury advises: “When joining the call, please let the operator know that you are a primary Tribal leader and would like to make comments. All others are invited to join in listen-only mode.”
